Recently the Trademark Trial and Appeal Board (“TTAB”) sustained The Trademark Company’s Notice of Opposition in the matter of LA Gear, Inc. vs. Sumner Widdoes, Opposition No. 91213609.

On November 21, 2013 LA Gear, Inc. filed an Opposition Proceeding seeking to block the registration of the trademark OK LA applied for by Ms. Widdoes in regard to a line of clothing.  LA Gear, Inc. is the owner of the famous LA GEAR brand used in connection with shoes and other items of apparel.

Following the filing of the initial pleadings and on the strength thereof the defendant failed to answer the Notice of Opposition in the time required under the rules.  Thereafter, the TTAB ruled Ms. Widdoes to be in default which ultimately led to the TTAB sustaining LA Gear, Inc.’s Notice of Opposition and denying Ms. Widdoes’s trademark application.
