The Trademark Company is pleased to announce that has secured the rights to the trademark FASHION WORLD MEDIA for one of its clients following a refusal to register the trademark by the U.S. Patent and Trademark Office.

By way of history, a customer filed an application for FASHION WORLD MEDIA on or about September 6, 2012 seeking to register the trademark for use in connection with a social media network in the fashion industry.

Registration of the trademark was initially refused on both the grounds that the U.S. Patent & Trademark Office believed the trademark was merely descriptive of the applicant’s social networking services as well as a likelihood of confusion with another registered trademark.

Unable to overcome the refusal on its own, the applicant turned to The Trademark Company to present arguments in support of registration.  Despite the company’s best efforts, the examining attorney maintained the complex dual refusals at issue.  As a result, The Trademark Company appealed the refusals to the Trademark Trial and Appeal Board (“TTAB”).

Following the submission of its brief in support of registration to the TTAB, however, the refusals were withdrawn by the examining attorney and the application is now in the final stages of the registration process.
