The Trademark Company is pleased to announce that it has secured the rights to the trademark SKETXHY CHIX (Ser. No. 85802741) for Tonika Grant following a refusal to register the trademark by the U.S. Patent and Trademark Office.

By way of history, The Trademark Company filed Ms. Grant’s application to register the trademark  SKETXHY CHIX  with her line of clothing on December 14, 2012.

Registration of the trademark was initially refused on the grounds that, if registered, the trademark would create a likelihood of confusion with another prior registered trademark.

The Trademark Company presented arguments in support of registration to the examining attorney.  However, even viewing those arguments the examining attorney refused to reverse the refusal of the trademark application.  Undeterred, The Trademark Company appealed the refusal to the Trademark Trial and Appeal Board (“TTAB”).

Following the submission of strong arguments in support of registration to the TTAB the refusal was withdrawn by the examining attorney and the application is now in the final stages of the registration process.
