On February 15, 2013 Todd Pekar, by and through counsel The Trademark Company, filed a Notice of Opposition with the Trademark Trial and Appeal Board (“TTAB”) seeking to block the registration of the trademark IMPACT ROTARY.

The case was aggressively litigated from its onset through discovery.  Prior to trial Defendant initiated steps which ultimately led to his defaulting in the matter.

As a result, on January 9, 2014 the TTAB awarded victory to The Trademark Company’s client Mr. Pekar, sustained the opposition, and blocked the registration of the trademark IMPACT ROTARY.
