On December 4, 2014 the Trademark Trial and Appeal Board (“TTAB”) dismissed Lone Tree Printing’s opposition proceeding against Edward Zinner (“Mr. Zinner”) and his efforts to register the trademark ED ZINNER, Opp. No. 91218216.
By way of history, Lone Tree Printing had filed an opposition proceeding seeking to block the registration of Mr. Zinner’s trademark used in connection with his services as an entertainer. Examining the initial pleadings filed by Lone Tree Printing, counsel for The Trademark Company determined that the matter had been improperly plead and, as a result, in lieu of filing an answer to the case filed a motion to dismiss the matter outright.
Lone Tree Printing failed to respond to the motion to dismiss and, accordingly, the TTAB entered an order dismissing the matter in favor of Mr. Zinner on the motion filed by The Trademark Company. As a result thereof, Mr. Zinner’s application to register his trademark is now pending registration before the U.S. Patent and Trademark Office.
