Recently the U.S. Patent and Trademark Office (“USPTO”) accepted The Trademark Company’s argument in support of registration of Joseph Gabbay’s trademark application for MANZINI UOMO (U.S. Ser. No. 86120148) approving the trademark for publication and registration on the Principal Register for the USPTO.

By way of history, Mr. Gabbay applied to register the trademark on November 15, 2013 for use in connection with a variety of clothing items.  On March 4, 2014 the USPTO refused registration of the application under Section 2(e)(4) of the Trademark Act holding that the trademark is primarily merely a surname and thus not entitled to registration.

Following the refusal, Mr. Gabbay authorized The Trademark Company to present arguments in support of registration of the trademark application.  As stated above, the USPTO accepted The Trademark Company’s argument and the trademark is now pending registration before the USPTO.
