On or about August 6, 2014 The Trademark Company successfully overcame a refusal to register the trademark TIRUPATHI (Ser. No. 85879478) issued by the U.S. Patent and Trademark Office (“USPTO”).
By way of history, Mahalakshmi Brand, LLC applied to register the trademark TIRUPATHI in connection with various food items on or about March 19, 2013. On June 27, 2013 the USPTO refused to register the trademark on the grounds that, in their opinion, the trademark was merely geographically descriptive of the applicant’s goods.
Mahalakshmi Brand, LLC authorized The Trademark Company to respond to the refusal to register the trademark. In turn, The Trademark Company crafted a custom, detailed response as to why, as applied to the applicant’s goods, the trademark at issue would not be considered geographically descriptive by the relevant consuming public. As set forth above, the argument was recently accepted by the USPTO and the trademark is now awaiting its publication for opposition, the next step in the registration process.
