Keep Your Mark Registered. Make it Incontestable.
Once your trademark is registered make sure it stays registered. Additionally, once your mark has been registered on the Principal Register for five (5) years have The Trademark Company make your registration incontestable as to almost all challenges which could be set forth in a Cancellation Proceeding.
A Section 8 Affidavit of Continuous Use is required to be filed between the fifth (5th) and sixth (6th) year anniversaries of the registration of the mark.
A Section 15 Declaration of Incontestability may be filed between the fifth (5th) and sixth (6th) year anniversaries of the registration of the mark. This declaration removes the ability of third parties to cancel a registration on all grounds except for fraud or abandonment of the registration.
A Section 8 Affidavit of Continuous Use and a Section 9 Application for Renewal must be filed between each nine (9) and ten (10) year anniversaries of the registration of the mark.
